1. Purpose
This policy establishes a clear and enforceable prohibition on the use of the 'Too Good To Go' platform — or any similar third-party discount or surplus retail application — by Edible Arrangements franchise and corporate store locations. This policy is issued to protect brand integrity, ensure product quality control, and maintain compliance with required order processing standards.
2. Background
'Too Good To Go' is a consumer-facing mobile application that allows retailers to sell surplus or overstocked items to customers at a substantial discount. While the platform has gained popularity across the retail food industry, its use by Edible Arrangements stores presents two material compliance risks that are incompatible with our brand and operational standards:
- Product Quality Standards — Items sold through this platform are not subject to Edible Arrangements' established quality control processes. The sale of non-conforming or overstocked product under the Edible Arrangements brand undermines our commitment to delivering a premium customer experience and poses reputational and food safety risks.
- Order Recording Requirements — Transactions conducted through 'Too Good To Go' are not processed through the Store Management System (SMS). All customer transactions must be recorded in SMS to ensure accurate reporting, inventory tracking, and financial reconciliation. Sales completed outside of SMS are a direct violation of our operational and financial compliance requirements.
3. Policy Statement
⚠ MANDATORY COMPLIANCE REQUIREMENT
Effective immediately, all Edible Arrangements store locations are strictly prohibited from using the 'Too Good To Go' platform or any equivalent surplus discount retail application.
All active listings on 'Too Good To Go' must be removed without delay. Stores must not create new listings, activate accounts, or otherwise engage with the platform going forward. |
This prohibition is effective immediately and applies to all current and future store locations, whether franchise-owned or corporate-operated.
4. Required Actions
Upon receipt of this policy, all store owners and operators must take the following actions immediately:
- Remove all active listings from the 'Too Good To Go' platform.
- Deactivate any 'Too Good To Go' store account associated with your location.
- Confirm with your Regional Director of Operations (RDO) that your store is no longer active on the platform.
- Ensure all team members and managers are informed of this policy and its immediate effective date.
- Process all customer transactions — including any discounted or promotional items — exclusively through the Store Management System (SMS).
5. Consequences of Non-Compliance
Edible Arrangements takes compliance with this policy seriously. Stores found to be in violation will be subject to the following actions, which may be applied individually or in combination depending on the severity and duration of the violation:
- Non-Compliance Classification: The store will be formally placed into non-compliance status.
- Rebate Program Ineligibility: Non-compliant stores will be ineligible to participate in any current or future Edible Arrangements rebate programs for the duration of their non-compliance status.
- Independent Audit: Non-compliant stores will be subject to an unannounced independent operational audit to assess the full scope of the violation and identify any additional areas of concern.
- Further Corrective Action: Depending on audit findings, additional corrective measures, may be taken.
6. Exceptions
No exceptions to this policy are permitted. There is no approved use case for the 'Too Good To Go' platform or any equivalent surplus discount application within Edible Arrangements store operations. Requests for exceptions will not be considered.
